Q. If a section 18(1) Learner successfully completed his / her Learnership and the company does not have a vacant position, can the persons services be terminated?

A. No, should the Learner successfully complete his / her Learnershipand thereis no vacant position the Learner must return to his / her original position. This must be negotiated with the Learner before entering into the Learnership.

Q. What must I do to be trained by the MQA?

A The MQA does not train Learners. The MQA is only financially assisting employers to do training.

Q. What must I do to be registered as a Learner?

A. The first step is to find an employer that will be willing to employ you as a Learner. Once you are employed the employer and the accredited training provider will register you as a Learner with the MQA.

Q. After I have completed my training, must the employer offer me a permanent job?

A. The employer is not forced to employ you. Your contract of employment lapsed the day that you successfully complete your Learnership.

Q. What is the minimum qualification that a prospective Learner must have before entering into a Learnership?

A. Because the Act and the Learnership regulations are silent on that, it is the employer’s prerogative to prescribe the minimum entrance qualification.

Q. I have completed my training, how can I claim my grant?

A The MQA grants is not payable to individuals, MQA grants are getting paid to employers who are paying skills levies to the MQA and who are training Learners in learnerships and skill programmes.

Q. We are accredited by the MQA and we have obtained programme approval from another SETA can we capture the other SETA’s Learners on DataNet?

A. No, You can only capture employees of the Mining, Jewellery and Diamond Sectors on DataNet. Training Providers must have their own computer programmes to accommodate Learners from other SETAs.

Q. There are people working for us for many years and we want to give them Recognition for Prior Learning (RPL), what are the MQA’s criteria for RPL and if they are assessed will the MQA issue them with a certificate.

A. The Learnership Unit is in process of developing a policy guideline for RPL. The MQA can only certify a person for RPL once the board had approved the RPL policy / criteria.

Q We understand that there is a Tax incentive available when training Learners on registered Learnerships. Where and how do we claim the Tax incentives?

A. There are two tax incentives, one at the beginning of the Learnership and one at the successful conclusio
